Aquafest 2026 — Vendor Rules & Regulations

1. Your application will be considered based on the items listed for sale. You must provide an accurate representation of what you plan to sell. All items listed may not be approved.
2. Vendor booths must open on time every day (Friday noon, Saturday & Sunday 10 AM) and stay open until 9 PM on Friday & Saturday, 5 PM on Sunday. Opening late, closing early, or tearing down early will result in not being invited back.
3. You are required to have someone present in your booth at all times during operating hours. If you need a break, ask for an Aquafest Volunteer to stand in.
4. Booth space is 10x10 feet. You must be fully contained within your assigned space. Extending beyond with awnings, racks, or displays will result in a $50 charge per additional 10x10 space.
5. Vendors are responsible for collecting applicable sales tax and reporting all sales to the WA State Department of Revenue using tax code 3109.
6. Vendors must provide their own tables, chairs, canopies, displays, and extension cords.
7. No music or hawking within your booth or anywhere around Aquafest. No roving with merchandise, flyers, or sandwich boards.
8. No generators are allowed. Electrical power must be purchased during registration ($50 non-food, $100 food vendors).
9. Aquafest has no paid security. You are responsible for removing valuables from your booth at the end of each day.
10. All booth spaces must be cleaned of trash and debris at the end of each day. Use the dumpsters provided, not perimeter trash bins.
11. Incomplete applications & payment will be rejected. Payments returned for NSF or declined credit cards are immediate rejections.
12. Cancellations after June 30th will not be refunded under any circumstances.
13. Liability insurance showing Lake Stevens Aquafest Association and City of Lake Stevens as additionally insured must be provided by setup day (July 10th, 2026).
14. Aquafest reserves the right to limit how many booths sell the same or similar products, with preference given to returning vendors.
15. No firearms, weapons, illegal items, or alcohol may be sold or displayed.

Aquafest 2026 — Vendor Waiver, Release & Indemnification Agreement

In consideration of being allowed to participate in the 2026 Aquafest Festival and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged:

RELEASE AND WAIVER:

The undersigned, for myself, executors, personal agents, personal representatives, administrators, successors and assigns, and for the Organization the undersigned represent and its members participating in the 2026 Aquafest Festival, hereby unconditionally RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE AQUAFEST ASSOCIATION, AQUAFEST BOARD OF DIRECTORS, THE CITY OF LAKE STEVENS, THE LAKE STEVENS SCHOOL DISTRICT, MEMCAP LLC, any and ALL AQUAFEST SPONSORS, and each of their respective officers, employees, agents, representatives, successors, or assigns (hereinafter referred to as "THE RELEASED PARTIES") from any liability resulting from any personal injury, accident or illness (including death), and/or property loss, however caused, and all consequential, compensatory, general, special, and/or statutory damages or liabilities, known or unknown, which may result in directly or indirectly or which are in any way related to or arise from our coming to, participating in, or the departing from the LAKE STEVENS AQUAFEST FESTIVAL, including claims based upon the active or passive negligence of THE RELEASED PARTIES.

INDEMNIFICATION AND HOLD HARMLESS:

The undersigned also hereby agree to INDEMNIFY, DEFEND AND HOLD THE RELEASED PARTIES HARMLESS from any and all claims, actions, suits, procedures, costs, manner of action or actions, cause and causes of action, claims, demands, loss of services, expenses, damages and liabilities including, but not limited to, attorney's fees arising from, or in any way related to, Participant's participation in the LAKE STEVENS AQUAFEST FESTIVAL.

SEVERABILITY:

The undersigned expressly agree that the foregoing WAIVER, RELEASE AND INDEMNIFICATION AGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the State of Washington and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

PHOTOGRAPHY WAIVER:

The undersigned hereby gives THE RELEASED PARTIES the irrevocable right to use and make photographs (still, film, tape or otherwise), to use and record with video or audio recording device, the undersigned name (or any fictional name), picture, portrait, photograph, and/or likeness in all forms and in all media including, but not limited to, brochures and websites, social media (e.g. Facebook, X, Instagram, TikTok) and in all manners ("Likeness"), without any restriction as to changes or alterations including but not limited to blurring, distortion, alteration, optical illusion or use in composite form, or derivative works of undersigned's Likeness made in any medium, activity(ies), products and/or services, including but not limited to for advertising, for publication or any other lawful purposes. The undersigned waives any right to inspect, modify or approve any intermediary version(s) of the results of the use of the undersigned's likeness ("RESULTS"). The undersigned waives any right to further compensation.

ACKNOWLEDGMENT OF UNDERSTANDING:

The undersigned having full authority to have been authorized by the Organization they represent as identified below, to execute this WAIVER, RELEASE, AND INDEMNIFICATION AGREEMENT on my and their behalf and on behalf of any members of the Organization participating in the LAKE STEVENS AQUAFEST FESTIVAL. The undersigned acknowledges any and all members have read the WAIVER, RELEASE, AND INDEMNIFICATION AGREEMENT as condition of and before being permitted to participate in the LAKE STEVENS AQUAFEST FESTIVAL. The undersigned understands this WAIVER, RELEASE, AND INDEMNIFICATION AGREEMENT, that the undersigned is giving up substantial rights in connection therewith, and that its terms are contractual, and not a mere recital.

REFUND AND/OR CANCELLATION POLICY:

We regret that Aquafest Vendor Reservations cannot be exchanged or refunded after purchase unless there is agreement to such by the Aquafest Executive Board of Directors and/or the event is cancelled completely.

The undersigned acknowledges that they have read and are signing this agreement freely and voluntarily.
