Welcome to the Lake Stevens Aquafest website ("Site"). By accessing or using this Site, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

Lake Stevens Aquafest ("Aquafest," "we," "us," or "our") is a 501(c)(4) community organization that operates the annual Lake Stevens Aquafest festival in Lake Stevens, Washington.

1. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You may not:

• Use the Site in any way that violates applicable federal, state, or local laws
• Submit false, misleading, or fraudulent information through any form
• Attempt to interfere with or disrupt the Site's functionality, security, or infrastructure
• Use automated tools (bots, scrapers) to access the Site without prior written permission
• Impersonate any person or entity, or misrepresent your affiliation

2. Registration and Accounts

Certain features of the Site (admin dashboard, vendor/sponsor management) require account creation. When you create an account:

• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activity that occurs under your account
• You agree to provide accurate and complete information
• You must notify us immediately if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.

3. Vendor, Sponsor, and Volunteer Registrations

By submitting a registration form on the Site:

• You represent that all information provided is accurate and complete
• You agree to the rules, waivers, and terms presented during the registration process
• Registration does not guarantee acceptance — Aquafest reserves the right to approve, reject, or revoke any registration at its sole discretion
• Digital signatures submitted through the Site are legally binding
• Required documents (insurance certificates, permits) must be valid and current

4. Payments, Tickets, and Donations

Payments

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's Terms of Service.

Tickets

• Tickets are non-transferable unless otherwise stated
• Each ticket includes a unique QR code for one-time validation
• Aquafest reserves the right to refuse entry if a ticket has already been scanned or is suspected of fraud
• Ticket sales may be subject to capacity limits

Refunds

• Vendor/sponsor registration fees: Refund requests must be submitted in writing to lakestevensaquafest@gmail.com. Refunds are issued at Aquafest's discretion.
• Tickets: Refunds for ticket purchases may be available up to 48 hours before the event. After that, tickets are non-refundable.
• Donations: Donations are non-refundable. Tax-deductibility is subject to IRS regulations for 501(c)(4) organizations.

Donations

Aquafest is a 501(c)(4) social welfare organization. Donations to 501(c)(4) organizations are generally not tax-deductible as charitable contributions. Consult your tax advisor for guidance.

5. SMS Text Alerts

By opting in to SMS text alerts:

• You consent to receive automated text messages at the phone number you provide
• Message frequency varies; up to approximately 10 messages during the festival weekend
• Message and data rates may apply
• Consent is not a condition of any purchase or registration
• Reply STOP at any time to opt out; reply HELP for assistance

6. Email Communications

By providing your email address through any form on the Site, you may receive:

• Transactional emails related to your registration, purchase, or inquiry
• Newsletter and event updates (if you subscribe)

You may unsubscribe from marketing emails at any time via the unsubscribe link in each email. Transactional emails related to active registrations cannot be opted out of.

7. Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is the property of Lake Stevens Aquafest or its licensors and is protected by copyright, trademark, and other intellectual property laws.

• The Aquafest name, logo, and brand elements are trademarks of Lake Stevens Aquafest
• You may not reproduce, distribute, or create derivative works from Site content without written permission
• Sponsor and vendor logos displayed on the Site remain the property of their respective owners and are used with permission

8. User-Submitted Content

By submitting content to the Site (form responses, photos, descriptions, brand materials), you grant Aquafest a non-exclusive, royalty-free license to use, display, and reproduce such content for the purposes of operating the festival and promoting future events.

9. Disclaimer of Warranties

The Site and all services are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• That the Site will be uninterrupted, error-free, or secure
• That information on the Site is accurate, complete, or current

Event schedules, vendor participation, and entertainment are subject to change without notice.

10. Limitation of Liability

To the fullest extent permitted by law, Aquafest, its officers, directors, volunteers, and technology partners (including Memcap) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Site
• Any errors, omissions, or inaccuracies in Site content
• Unauthorized access to or alteration of your data
• Any third-party conduct on the Site
• Event cancellations, schedule changes, or weather-related disruptions

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to Aquafest through the Site in the 12 months preceding the claim.

11. Assumption of Risk

Attendance at Aquafest events involves inherent risks. By attending or participating, you acknowledge and assume all risks associated with festival activities, including but not limited to: rides, water activities, crowds, weather, and food consumption. Specific waivers may be required for certain activities and are agreed to during registration.

12. Indemnification

You agree to indemnify and hold harmless Aquafest, its officers, directors, volunteers, sponsors, and technology partners from any claims, damages, or expenses (including attorney's fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

13. Technology Service Provider

This website is built and managed by Memcap ("Technology Provider") on behalf of Lake Stevens Aquafest. Memcap provides the technology platform, development, and hosting services that power this Site.

• Memcap acts as a service provider to Aquafest — not as a party to any transaction between you and Aquafest
• Memcap is not responsible for Aquafest's event operations, vendor/sponsor decisions, refund determinations, or festival activities
• Memcap's liability is limited to the technology services it provides and is subject to the same limitations described in Section 10
• All content decisions, registration approvals, and event operations are the sole responsibility of Lake Stevens Aquafest

14. Third-Party Links and Services

The Site may contain links to third-party websites and services. We are not responsible for the content, policies, or practices of any third-party sites. Your interactions with third parties are solely between you and the third party.

15. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Snohomish County, Washington.

16. Changes to These Terms

We may modify these Terms at any time. Changes take effect when posted on this page with an updated effective date. Your continued use of the Site after changes constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
